1. Acceptance of Terms

By registering for and using PixMMO, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the service. We reserve the right to update these terms at any time, and continued use of the service after changes constitutes acceptance of the revised terms.

2. Eligibility

You must be at least 13 years of age to create an account and use PixMMO. By registering, you confirm that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian to use the service. Under German law (§§ 107, 108 BGB), if you are a minor, any purchase of Gems, Premium status, or other paid content requires the consent of your parent or legal guardian; purchases made without such consent may be unwound at our discretion.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at [email protected]. PixMMO is not liable for any loss or damage arising from your failure to keep your account secure.

4. License and Intellectual Property

PixMMO grants you a limited, non-exclusive, non-transferable license to access and use the game for personal, non-commercial purposes. All content, trademarks, logos, and intellectual property associated with PixMMO remain the exclusive property of PixMMO and its operators. You may not reproduce, distribute, or create derivative works without express written permission.

5. Prohibited Conduct

You agree not to:

• Use the service for any unlawful purpose or in violation of applicable laws.
• Attempt to gain unauthorized access to any part of the service or its infrastructure.
• Transmit any harmful, offensive, or disruptive content.
• Use automated tools, bots, or scripts to interact with the service.
• Sell, trade, or transfer your account to another person.
• Engage in any activity that disrupts or interferes with the service.

6. Virtual Items and Currency

Any virtual items, currency (including Gems), Premium status, or other in-game assets are licensed to you for use within PixMMO only, whether obtained through gameplay or purchase. They have no real-world monetary value, cannot be exchanged for real money or goods, and cannot be transferred outside the game. We reserve the right to modify, rebalance, or discontinue virtual items at any time. You have no ownership rights over virtual items — your rights are limited to the license described here.

7. Purchases and Payment

Gems, cosmetics and Premium status can be purchased for real money through our in-game store. Payments are processed by PayPal or Stripe (in the Android app, by Google Play); we do not receive or store your full payment card or account details. Prices are displayed in the currency shown at checkout at the time of purchase. By completing a purchase, you confirm that you are authorized to use the selected payment method.

Products and prices.The store offers Gems, cosmetics, bundles, one-time Premium / Premium+ for a fixed number of days, and monthly Premium / Premium+ subscriptions. Each product page and the checkout show what you receive, the total price and, for subscriptions, the billing interval. The price shown at checkout is the final price. No VAT is charged under § 19 UStG (small business regulation). Offers marked as "once per account" (e.g. the Starter Pack) can only be bought once per account.

Conclusion of contract.The store listing is not a binding offer. By pressing the final button ("Buy now — payment required" or "Subscribe now — payment required") you make a binding offer; the contract is concluded when the payment provider confirms your payment and the content is credited to your account. After every purchase we send you a confirmation email with the contract details.

Right of Withdrawal. As a consumer you generally have a 14-day right of withdrawal. Gems, Premium status and other store content are digital content delivered to your account immediately. At checkout you must actively tick a box confirming that you expressly request delivery to start before the withdrawal period ends and that you know you lose your right of withdrawal once delivery has begun (Section 356(5) of the German Civil Code (BGB), Art. 16(m) of Directive 2011/83/EU). We record this consent with each purchase and confirm it in the confirmation email. Without it, a purchase is not possible. Your statutory rights are otherwise unaffected, including warranty rights that cannot be excluded by agreement.

Refunds. Except where required by law or where content is not delivered due to a fault on our part, purchases are final and non-refundable. If you believe a purchase failed or was incorrectly charged, contact us at [email protected] and we will investigate.

One-time Premium. One-time Premium / Premium+ runs for the number of days shown at checkout. It does not renew automatically, and nothing further is charged when it ends.

Premium subscriptions. Monthly Premium / Premium+ subscriptions renew automatically at the end of each paid period and are charged in advance through the payment method you chose (PayPal or Stripe; in the Android app, Google Play). Premium is extended once each payment has been received. Premium+ subscribers also receive the monthly Gems shown in the store once per paid period.

Cancellation.You can cancel a subscription at any time, without giving a reason, effective at the end of the current paid period — on your account page or, without logging in, via the "Cancel contracts here" button / page at /cancel-contracts (Section 312k BGB). Subscriptions billed through Google Play must also be cancelled in the Play Store. You keep Premium until the end of the period you already paid for; paid periods are not refunded pro rata. The right of both parties to cancel for good cause (extraordinary cancellation) remains unaffected. We confirm every cancellation by email.

Changing tier. An upgrade from Premium to Premium+ applies immediately; the higher price is charged from the next billing date. A downgrade takes effect at the next billing date. While a subscription is active, one-time Premium cannot be bought for the same account.

Failed payments. If a renewal payment fails, we notify you by email. Premium you have already paid for is not taken away; if no payment is received, the subscription is not extended.

Price changes.We may change prices for new purchases at any time. For an existing subscription, a price change only applies if we tell you at least 30 days before it takes effect and you do not cancel before then; the notice will point out your right to cancel and what happens if you don't.

We are not obligated to participate in, and do not voluntarily participate in, dispute resolution proceedings before a consumer arbitration board (§ 36(1) No. 1 VSBG).

8. Service Availability

We strive to keep PixMMO available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or our Game Rules, without prior notice. You may also request deletion of your account by contacting us at [email protected].

10. Limitation of Liability

PixMMO and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service. Our total liability to you for any claim shall not exceed the amount you have paid us in the twelve months preceding the claim. This limitation does not apply to damages resulting from intent or gross negligence, or to injury to life, body, or health, or to any other liability that cannot be excluded or limited under applicable law.

11. Governing Law

These Terms and Conditions are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence. Where legally permissible, disputes shall be subject to the courts in Germany; this does not restrict any right you may have as a consumer to bring proceedings in the courts of your own country of residence.
