Terms and Conditions

1. Acceptance of Terms

By registering for and using PixMMO, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the service. We reserve the right to update these terms at any time, and continued use of the service after changes constitutes acceptance of the revised terms.

2. Eligibility

You must be at least 13 years of age to create an account and use PixMMO. By registering, you confirm that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian to use the service. Under German law (§§ 107, 108 BGB), if you are a minor, any purchase of Gems, Premium status, or other paid content requires the consent of your parent or legal guardian; purchases made without such consent may be unwound at our discretion.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at contact@pixmmo.de. PixMMO is not liable for any loss or damage arising from your failure to keep your account secure.

4. License and Intellectual Property

PixMMO grants you a limited, non-exclusive, non-transferable license to access and use the game for personal, non-commercial purposes. All content, trademarks, logos, and intellectual property associated with PixMMO remain the exclusive property of PixMMO and its operators. You may not reproduce, distribute, or create derivative works without express written permission.

5. Prohibited Conduct

You agree not to:

• Use the service for any unlawful purpose or in violation of applicable laws.
• Attempt to gain unauthorized access to any part of the service or its infrastructure.
• Transmit any harmful, offensive, or disruptive content.
• Use automated tools, bots, or scripts to interact with the service.
• Sell, trade, or transfer your account to another person.
• Engage in any activity that disrupts or interferes with the service.

6. Virtual Items and Currency

Any virtual items, currency (including Gems), Premium status, or other in-game assets are licensed to you for use within PixMMO only, whether obtained through gameplay or purchase. They have no real-world monetary value, cannot be exchanged for real money or goods, and cannot be transferred outside the game. We reserve the right to modify, rebalance, or discontinue virtual items at any time. You have no ownership rights over virtual items — your rights are limited to the license described here.

7. Purchases and Payment

Gems and Premium status can be purchased for real money through our in-game store. Payments are processed by PayPal; we do not receive or store your full payment card or account details. Prices are displayed in the currency shown at checkout at the time of purchase. By completing a purchase, you confirm that you are authorized to use the selected payment method.

Right of Withdrawal. Purchases of Gems and Premium status are digital content delivered to your account immediately upon successful payment. By completing a purchase, you expressly request and consent to immediate delivery, and you acknowledge that — once delivery has begun — you lose your statutory 14-day right of withdrawal pursuant to Section 356(5) of the German Civil Code (BGB) and Art. 16(m) of Directive 2011/83/EU. Your statutory rights are otherwise unaffected, including any warranty rights that cannot be excluded by agreement.

Refunds. Except where required by law or where content is not delivered due to a fault on our part, purchases are final and non-refundable. If you believe a purchase failed or was incorrectly charged, contact us at contact@pixmmo.de and we will investigate.

Premium status is sold as a fixed-term, one-time purchase for the number of months selected at checkout. It does not automatically renew or recur, and no further payment will be taken after it expires unless you make a new purchase.

We are not obligated to participate in, and do not voluntarily participate in, dispute resolution proceedings before a consumer arbitration board (§ 36(1) No. 1 VSBG).

8. Service Availability

We strive to keep PixMMO available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or our Game Rules, without prior notice. You may also request deletion of your account by contacting us at contact@pixmmo.de.

10. Limitation of Liability

PixMMO and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service. Our total liability to you for any claim shall not exceed the amount you have paid us in the twelve months preceding the claim. This limitation does not apply to damages resulting from intent or gross negligence, or to injury to life, body, or health, or to any other liability that cannot be excluded or limited under applicable law.

11. Governing Law

These Terms and Conditions are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence. Where legally permissible, disputes shall be subject to the courts in Germany; this does not restrict any right you may have as a consumer to bring proceedings in the courts of your own country of residence.
